Harvey L. Bryant, Commonwealth’s Attorney for the City of Virginia Beach, announced that Antonio Levon Waller, 37 years old, who previously resided in the 300 block of Pelfley Drive, Norfolk, Virginia, was found guilty on May 5, 2009 by a jury on charges of one (1) count of Possession of a Controlled Substance with the Intent to Distribute and one (1) count of Conspiracy to Violate the Drug Control Act. The jury recommended a total of 25 years in prison. On August 18, 2009, Circuit Court Judge Edward W. Hanson, Jr. imposed the sentence recommended by the jury.
The Commonwealth’s evidence proved beyond a reasonable doubt that on May 10, 2008, Antonio Waller, in a conspiracy with another defendant, sold approximately 4 grams of cocaine to an undercover detective. Waller met the detective on Mediterranean Avenue, where he negotiated the price of the cocaine. The defendant contacted another individual, who had physical possession of the cocaine, on the telephone. The cocaine was delivered to the detective and the coconspirator concluded the transaction brokered by Waller.
In 1990, Waller was convicted in Virginia Beach of possessing cocaine with intent to distribute it, and received an eight (8) year sentence; in 2000, he was convicted in Norfolk of conspiring to distribute cocaine, but his sentence of seven (7) years was suspended, except for one (1) year and eight (8) months. The suspended portion was revoked three times in Norfolk, but only resulted in an additional twelve (12) months to serve for the combined revocations. In Virginia Beach in 2007, Waller was convicted of another felony drug charge, and that entire five (5) year sentence was suspended, except for six (6) months.
