Harvey L. Bryant, Commonwealth’s Attorney for the City of Virginia Beach, announced today that Vincent Michael Barrett, 27 years old, previously residing in the 3000 block of Birch Bark Road in Virginia Beach, Virginia pled guilty before Circuit Court Judge Les Lilley to charges of Aggravated Sexual Battery-Victim under Age 13, Burglary with the intent to Rape, Eluding Police-Endangerment, two (2) counts of Hit and Run-Damage to Attended Property, Driving Under the Influence, Driving on a Suspended Operator’s License, and Hit and Run-Property Damage Unattended over $250. Judge Lilley accepted the plea agreement and sentenced Barrett to 55 years and 36 months in the Department of Corrections with all suspended except 20 years.
“This case is every parent’s nightmare. The prospect of their young child having to recount the horror in open court compounded the tragedy for this family,” Bryant said. “The parents’ concerns were strongly considered in fashioning the sentence.”
Had this matter gone to trial, the Commonwealth’s evidence would have proved that on May 5, 2011, Vincent Michael Barrett was drinking alcohol at a bar in the Great Neck area then drove to a neighborhood in the Red Mill area of Virginia Beach. Shortly after 3:00 a.m., he entered the home of a family he did not know through their unlocked front door. Barrett went directly to the bedroom of a sleeping child and locked the door behind him. He told her to be quiet and covered her mouth as he sexually assaulted her. The child’s father heard her screaming and ran to her aid. Barrett came out of the child’s room naked from the waist down and fought with the father before running from the home.
Multiple police units responded to the scene and a pursuit ensued. Barrett drove over spikes set up by the police, flattening all four of his tires. He struck two police vehicles and a citizen’s parked car before coming to a stop on I-264 near First Colonial Road. A police dog was used to assist in Barrett’s apprehension and he was taken to the hospital for treatment. A blood draw was taken and his blood alcohol content registered .19, more than twice the legal limit for driving.
Barrett has previous convictions in Virginia Beach Circuit Court for Grand Larceny, Burglary, Receiving Stolen Property, Criminal Damage to Property, and a Violation of Probation.
