Commonwealth v. Tabibi: Drug Dealer on Bond and Awaiting Sentence Who Continued to Sell Drugs Sentenced to 11 Years

Harvey L. Bryant, Commonwealth’s Attorney for the City of Virginia Beach announced today that Shahab Tabibi, 26 years-old, previously residing in the 1200 Block of New Land Drive in Virginia Beach, was sentenced on Tuesday, May 25, 2010 by the Honorable A. Joseph Canada, Jr. to eighty-seven (87) years, with seventy-six (76) years suspended, for the crimes of three (3) counts of Possession of Schedule I or II Drug, two (2) counts of Possession with Intent to Distribute Schedule I or II Controlled Substances, and a Violation of Probation. Shahab Tabibi plead guilty to each of these charges on February 2, 2009 and March 23, 2010 respectively.

The Commonwealth’s evidence proved that on May 29, 2008, the defendant sold heroin to an undercover officer at Central 111, a restaurant in Virginia Beach. When the defendant was arrested on June 25, 2008, he was in possession of cocaine and heroin. During a search of the defendant’s bedroom police also found heroin and a digital scale. The defendant was released on an $18,000 secured bond pending trial. On February 2, 2009, the defendant plead guilty to the charges and remained on bond while awaiting sentencing. On May 10, 2009, the defendant brought 20 heroin capsules to a hotel room at a Motel 6 in Virginia Beach. He intended to sell these capsules for $144.00 when he was arrested. The defendant admitted to police that he was a heroin addict.

The defendant’s prior record includes one conviction for Possession of a Controlled Substance with the intent to Distribute.
