Harvey L. Bryant, Commonwealth’s Attorney for the City of Virginia Beach, announced today that Robert Allen Swanson, 51 years old, previously residing in the 4000 block of Roebling Lane, Virginia Beach,Virginia, was found guilty by a jury of Custodial Indecent Liberties and Aggravated Sexual Battery. The jury recommended that Swanson serve one (1) year for Custodial Indecent Liberties, and four (4) years for Aggravated Sexual Battery, along with a $2500 fine, for a total of five (5) years in the Virginia State Penitentiary. The Honorable A. Bonwill Shockley accepted the jury verdict and will pronounce a final sentence at a hearing scheduled for January 5, 2011. The defendant’s bond was revoked and he was taken into custody at the request of the Commonwealth.
The Commonwealth’s evidence proved that between January 1, 2007 and April 6, 2008, the defendant sexually assaulted a child under the age of thirteen while in his care.
While awaiting trial, the defendant was arrested for DUI and convicted of that charge on June 17, 2010, in Virginia Beach Circuit Court.
