Harvey L. Bryant, Commonwealth’s Attorney for the City of Virginia Beach, announced today that Ramal Kyhree Payne, 20 years old, previously residing in the 600 block of Old Post Road, Virginia Beach, Virginia, was sentenced today by Circuit Court Judge William R. O’Brien, Jr. to twenty-three (23) years for Conspiracy, Attempted Robbery and Use of a Firearm in the Commission of Attempted Robbery after a bench trial on April 22, 2009. The Judge ordered that all but twelve (12) years be suspended conditioned upon eleven (11) years good behavior upon his release, indeterminate supervised probation, and payment of court costs.
The Commonwealth’s evidence proved that on November 1, 2008, the victim was standing on his porch in the Chase Arbor Apartments when the defendant and co-defendant walked up to him. The co-defendant pointed a gun at the victim and the men demanded money. The victim did not surrender any property, and the two men ran away. Police K-9 officers encountered the men a short distance away and the co-defendant ran away. After the K-9 dog located the co-defendant, both men were identified by the victim. The dog also found a 9mm pistol nearby.
The defendant has an extensive juvenile criminal record.
The co-defendant’s case is presently set for sentencing on August 17, 2009.
