Harvey L. Bryant, Commonwealth’s Attorney for the City of Virginia Beach, announced today that Robert Victor Moller, 51 years old, previously residing in the 1400 block of Alanton Drive, Virginia Beach, Virginia, was found guilty after a two-day jury trial on March 24, 2010 that was presided over by Circuit Court Judge William R. O’Brien of one (1) count of Aggravated Sexual Battery, one (1) count of Indecent Liberties, one (1) count of Attempted Rape, one (1) count of Animate Object Sexual Penetration, and one (1) count of Oral Sodomy by Force. The jury recommended that the defendant be imprisoned for life plus an additional 70 years in the Virginia Department of Corrections, as well as a fine of $100,000 and court costs. The sentencing will be formally imposed June 15, 2010.
During the jury trial, the Commonwealth’s evidence proved that on the evening of April 24, 2008 the 11 year old victim disclosed to her mother that Moller had been sexually molesting her for a year. The victim’s mother confronted Moller about the sexual abuse and he admitted touching the victim in an inappropriate way. The mother reported the abuse to the Virginia Beach Police Department the next morning. The sexual abuse occurred in the victim’s home when the mother was asleep or away from the home running errands.
The defendant has no prior criminal history.
