Commonwealth v. Mitchell; Jury Recommends 30 Years for Robber

Harvey L. Bryant, Commonwealth’s Attorney for the City of Virginia Beach, announced today that Marcys Alexander Mitchell, 47 years old, previously residing in the 5500 block of Gower Place,Virginia Beach, VA, was found guilty by a jury of one (1) count of robbery and one (1) count of wearing a mask in public at the conclusion of a two day jury trial presided over by Circuit Court Judge A. Bonwill Shockley. The jury recommended a sentence of twenty-five (25) years for the robbery charge and five (5) years for the wearing a mask in public charge to be served in the Virginia Department of Corrections. Mitchell will be sentenced on May 19, 2009.

At the jury trial that began March 10, 2009, the Commonwealth’s evidence proved that on the morning of February 28, 2007, while no other customers were in the building, Mitchell entered the front door of Loan Max Title Loans in the 1600 block of Laskin Road in Virginia Beach, and told the two employees inside that “this is a robbery”. At the time, Mitchell was wearing a sheer nylon mask that covered half of his face, a white surgical glove on his left hand and was holding a black gun that was wrapped in a white plastic bag in his right hand. At gunpoint, he ordered one of the victims to “get down under the counter,” and forced the other victim into the back office, where he demanded all the money, cash only, no change or checks. After the victim gave him the money, Mitchell ordered the victims to stay where they were and that he would be back in five minutes. As he fled through the front door, one of the victims called 911 while the other victim observed him discard the white surgical glove he had been wearing in the dumpster behind the building. The victims were able to identify Mitchell through a police line-up.

Mitchell is currently serving twenty-five (25) years for Suffolk convictions that include robbery, abduction and wearing a mask in public. He has also been convicted of three (3) counts of possession with intent to distribute cocaine, assault and battery and petit larceny.
