Commonwealth v. James Andrew Metcalf; Child Molester Gets 25 Years to Serve

Harvey L. Bryant, Commonwealth’s Attorney for the City of Virginia Beach, announced today that James Andrew Metcalf, 35 years old, previously residing in the 400 block of South Coconut Lane, Virginia Beach, Virginia, was sentenced today by Circuit Court Judge A. Joseph Canada, on one (1) count of Aggravated Sexual Battery, one (1) count of Indecent Liberties, and one (1) count of Object Sexual Penetration. Judge Canada ordered the defendant to serve a total of forty-five (45) years in the Virginia Department of Corrections. Twenty (20) years of that sentence were suspended conditioned upon good behavior for forty-five (45) years, indefinite supervised probation, and payment of all court costs.

The Commonwealth’s evidence proved that on January 27, 2009, a witness found Metcalfe and victim in a locked bedroom. When the door was opened, she found a nine (9) year old year old child on the floor with her pants down around her knees and the defendant standing behind the victim, also with his pants down. In an interview with Sgt. Jacquelynn Geluso of the Virginia Beach Police Department, the defendant admitted to sexually abusing the victim for a little over a year. After hearing evidence from the victim’s mother about how these crimes have affected the victim and her family, as well as considering a psychosexual evaluation that found that the defendant’s behavior met the criteria for a diagnosis of pedophilia, Judge Canada stated that the defendant presented an ongoing danger to the community and sentenced him above the high end of the guidelines to active incarceration of twenty-five (25) years.
