Harvey L. Bryant, Commonwealth’s Attorney for the City of Virginia Beach, announced today that James John Huber Jr., 27 years old, who previously resided in the 2800 block of North Landing Road, Virginia Beach, Virginia, was sentenced today by Circuit Court Judge Edward W. Hanson. On April 27, 2010, Huber pled guilty to one (1) count of Robbery, one (1) count of Attempted Robbery, and one (1) count of Eluding Police – Endangerment. Judge Hanson ordered him to serve a total of thirty-five (35) years in the Virginia State Penitentiary. The Court suspended execution of all but twelve (12) years of that sentence.
Had this matter gone to trial, the Commonwealth’s evidence would have proved that on March 18, 2009 at approximately 3:30 a.m., Huber attempted to rob the night clerk at the New Castle Motel, 732 Tilden Place in Virginia Beach, by implying he had a weapon. He demanded that the clerk give him money, but the clerk fled from the office. The clerk saw the defendant flee in a black Chevrolet pickup truck. Moments earlier, Huber entered the Seven-Eleven store at 317 32nd Street in Virginia Beach. Huber demanded the money from the cash register along with two packs of Marlboro cigarettes from the clerk on duty. The clerk gave Huber the money and he fled the store.
Virginia Beach Police stopped Huber driving a black pickup truck but he then fled with the police in pursuit. The pursuit reached speeds between 90 – 100 mph, and ended in Huber’s driveway on North Landing Road. The night clerk from the New Castle Motel identified Huber. The money from the Seven-Eleven and packs of cigarettes were recovered from Huber’s truck.
In addition to these latest convictions, the defendant has also been convicted of one (1) count of Possession of Schedule I/II drug, one (1) count of Distribution of an Imitation Controlled Substance, and one (1) count of Contempt of Court, in the Circuit Court for the City of Virginia Beach. The defendant has also been convicted of (1) count of Possession of Schedule I/II drug in the Circuit Court for the City of Portsmouth.
