Commonwealth v. Hodge; Pedophiliac to Serve 10 Years for Possession of Child Pornography

Release Date: Tuesday, October 6, 2009 4 p.m.

Harvey L. Bryant, Commonwealth’s Attorney for the City of Virginia Beach, announced today that Roy Harold Hodge, 34 years old, who previously resided in the 5800 block of Waxham Court, Virginia Beach, Virginia, was sentenced today by Circuit Court Judge Honorable Edward W. Hanson, Jr. on ten (10) counts of Possession of Child Pornography. Judge Hanson ordered the defendant to serve thirty-one (31) years in the Virginia Department of Corrections. The Court suspended twenty-one (21) years of that sentence, leaving the defendant a ten (10) year active sentence to serve.

Had this matter gone to trial, the Commonwealth’s evidence would have proved that Special Agents of the Naval Criminal Investigative Services (NCIS) discovered pornographic images on the defendant’s laptop computer in Washington State. After interviewing the defendant, the agents seized and reviewed additional computers belonging to the defendant at his home in Virginia Beach. According to the statement made by Hodge, he began downloading pornographic materials in 2003 out of curiosity and decided to keep them. When agents reviewed the three (3) computers at his home in Virginia Beach, there were 104,862 pornographic images of children. Additionally, Hodge had 205 video clips of child erotica.

A psycho-sexual evaluation was completed and the defendant met all the criteria necessary for a diagnosis of pedophilia. The computer analyst for the NCIS stated that this was one of the largest collections of child pornography that he had ever seen.

The defendant had no criminal record prior to his being caught in Washington. The Washington State authorities charged Hodge with one (1) count of possession of child pornography and sentenced him to one (1) year in jail.

Deputy Commonwealth’s Attorney Philip C. Hollowell prosecuted the case. Please call Julie Pickell if additional information is desired.
