Commonwealth v. Ephrim Lamar McCoy III; Armed Robber to Serve 13 Years

Harvey L. Bryant, Commonwealth’s Attorney for the City of Virginia Beach, announced today that Ephrim Lamar McCoy III, 26 years old, who previously resided in the 3300 Block of Bangor Court, Virignia Beach, VA, pled guilty and was sentenced today by the Honorable A. Bonwill Shockley to a total of thirty-eight (38) years for Aggravated Malicious Wounding, Robbery and two (2) counts of Use of a Firearm in the Commission of a Felony. Twenty-five (25) years of that sentence was suspended, leaving the defendant an active sentence of thirteen (13) years to serve in the Virginia Department of Corrections.

Had this matter gone to trial, the Commonwealth’s evidence would have proved that on the evening of May 7, 2008, the defendant, together with Randall Thigpen-Knight, and Christopher Joyner, forced their way into an apartment in the Indian Creek complex. Andrew Mattison was already in the apartment, visiting with the victims. McCoy and his codefendants forced one of the victims through the apartment at gunpoint in an attempt to find drugs and money. During the robbery, Antonio Elliott was shot in the head, but survived.

McCoy’s prior record includes convictions in Portsmouth, Virginia for Possession of Marijuana with the Intent to Distribute (2 counts), Possession of Cocaine with the Intent to Distribute, Possession of a Firearm while in Possession of Drugs and Concealed Weapon.

Randall Loren Thigpen-Knight pled guilty to Robbery, Malicious Wounding and Use of a Firearm in the Commission of a Felony on October 27, 2009. A pre-sentence report was ordered and sentencing is set for February 17, 2010.

Andrew Matthew Mattison Jr. is set to be tried by a jury on January 27, 2010 on charges of Robbery, Use of a Firearm in the Commission of a Felony, Driving while Operator’s License Revoked and Possession of Marijuana.

Christopher Lee Joyner, Jr. is set to be tried on March 10, 2010 on charges of Aggravated Malicious Wounding, Abduction, Robbery, Statutory Burglary, and Use of a Firearm in the Commission of a Felony (3 counts).
