Harvey L. Bryant, Commonwealth’s Attorney for the City of Virginia Beach, announced today that David Sunday Hemmingsen, 25 years old, previously residing in the 400 block of Cummings Road, Virginia Beach, Virginia, was sentenced by Circuit Court Judge Frederick B. Lowe on one count of Second Degree Murder and one count of Use of a Firearm in the Commission of a Felony. The defendant was sentenced to a total of forty-three (43) years in the Virginia State Penitentiary with ten (10) years suspended. The defendant’s period of active incarceration is thirty-three (33) years.
The Commonwealth’s evidence proved that on September 29, 2007, the defendant shot and killed Salvatore Cardona, age twenty-two (22), while they and other friends were in a hotel room at the America’s Best Value Inn located on Northampton Boulevard in the city of Virginia Beach. A verbal argument had taken place between the victim and one of the female occupants. The defendant did not like the victim disrespecting a female and pulled out a 10 mm Glock automatic handgun and, from close range, shot the victim once in the left side of his head. All of the other occupants left the room and the police were called. When they arrived at the hotel, the police found the defendant and the decedent in the room.
