Commonwealth v. Ash; Home Burglary with Prior Record to Serve Just 10 Years for Five Break-Ins

Harvey L. Bryant, Commonwealth’s Attorney for the City of Virginia Beach, announced today that Jonathan Ash, 27 years old, previously residing in the 1100 block of Pacific Avenue, Virginia Beach, was sentenced today by Circuit Court Judge A. Joseph Canada to a total of 60 years in the Virginia Department of Corrections. Ash received (5) years for each of the five (5) counts of Statutory Burglary; four (4) years each for five (5) counts of Grand Larceny; and three (3) years for (5) counts of Conspiracy. Fifty (50) years of Ash’s sentence was suspended leaving Ash ten (10) years to serve. This sentence exceed the high end of the guidelines. The suspended portion of his sentence is conditioned upon fifty (50) years good behavior, indefinite supervised probation and payment of restitution of over $15,000.00 after his release.

The Commonwealth’s evidence proved that between December 14, 2008 and December 21, 2008, Ash and a co-defendant broke a window with a rock and gained entry to a house in the 400 block of Lakewood Court. They stole $200.00 personal property. Ash sold the property to a Virginia Beach Cash Convertors on December 22, 2008.

Between December 26, 2008 and December 28, 2008, Ash and a co-defendant threw a brick through the back door glass and gained entry to a house in the 1600 block of Spring House Trail. Once inside they stole personal property.

Between the dates of December 25, 2008 and December 29, 2008, Ash and a co-defendant broke a window and gained entry into a home in the 300 block of Arctic Avenue. They stole property including a vehicle. Knives were recovered outside the victim’s bedroom which was locked at the time. Pry marks on the door indicated that the defendants used the knives to pry open the door. The co-defendant sold three of the stolen VCRs and a DVD player to a Norfolk Cash Converters. Ash pawned a stolen laptop at Langley Pawn. The victim’s car was later recovered.

On January 6, 2009, Ash and a co-defendant broke into a house, in the 300 block of Lake Drive, through a rear door and stole personal property. The co-defendant pawned some of the property at Cash Convertors the next day.

On January 8, 2009, Ash and a co-defendant were spotted by police coming from the bushes between two houses in the same neighborhood as several of these break-ins near the Oceanfront. They matched the descriptions of suspects in the break-ins. Ash was wearing a jacket that had been turned inside out to conceal the white writing on an otherwise black jacket. It was determined he had an outstanding warrant and was taken into custody. A search of the co-defendant revealed two screwdrivers, a flashlight and a knife in his pockets.

Ash admitted his involvement in all of these crimes. Cain Jones, co-defendant will be sentenced on September 29, 2009.

In addition to these convictions Ash has been convicted of Attempted Grand Larceny, Possession of Burglary Tools, and Petit Larceny in Norfolk.
