Criminal Record Checks Policy

My office checks criminal records from a nationwide database, using the FBI/State Police maintained system.

  • Only law enforcement has access to that system.

My office conducts criminal record checks an average of 2,000 times per month.

  • Verified by Virginia State Police.

Using those records, in District Court:

  • My staff responds to over 100 Bond Hearings per month;

In Circuit Court:

  • My prosecutors argue defendants appeals of District Court bond decisions an average of 50 times per month.

At any hearing, when asked by a judge “What is the defendant’s record”?

  • My prosecutors have always had and responded with that information.
  • This is and has been the office procedure for well over 10 years.
  • If these checks were not  done by my office ,defense attorneys  would be the 1st to complain,as they have no way of learning the true criminal records of their clients and witnesses until we provide them. Ask one .
